Terms of Service

These Terms of Service ("Terms") govern your access to and use of SpexCRM (the "Service"). By creating an account or using SpexCRM, you agree to these Terms on behalf of yourself and, if applicable, the Organization you represent.

The Service

SpexCRM is a customer relationship management platform that helps businesses manage clients, projects, invoicing, and related workflows. Features and plan limits are described on our Pricing page and may change as the Service evolves.

Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure. You're responsible for all activity that happens under your account, and for managing which users within your Organization have access to it.

Subscriptions & Billing

Paid plans are billed in advance on a recurring basis. Payments are processed by Paystack. Cancellation and refund terms are set out in our Refund & Cancellation Policy, which forms part of these Terms.

Your Data

You and your Organization retain ownership of all data you enter into SpexCRM — client records, projects, invoices, and everything else. We act as the processor of that data on your behalf, as described in our Privacy Policy. You're responsible for making sure you have the right to enter any third-party personal information (e.g. your own clients' details) into the platform.

Acceptable Use

You agree not to use SpexCRM to:

• Break any applicable law, including data protection laws governing information about your own clients;
• Send unsolicited bulk messages (spam) via the platform's email or WhatsApp features;
• Attempt to gain unauthorized access to another Organization's data or to the Service's infrastructure;
• Resell or sublicense the Service without our prior written consent;
• Interfere with or disrupt the integrity or performance of the Service.

Third-Party Services

SpexCRM integrates with third-party services (including Paystack, Twilio, and Elastic Email) to deliver certain features. Your use of those features is also subject to the relevant third party's own terms.

Intellectual Property

SpexCRM, its software, design, and branding are the property of Spectral Inc. and are protected by applicable intellectual property laws. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service normally.

Service Availability

We aim to keep SpexCRM reliable and available, but we don't guarantee uninterrupted access. We may occasionally need to perform maintenance or make changes that temporarily affect availability.

Termination

You may cancel your subscription at any time as described in our Refund & Cancellation Policy. We may suspend or terminate access to the Service if these Terms are breached, if payment is not received, or if we reasonably believe the account is being used in a way that harms SpexCRM, other customers, or the Service itself.

Disclaimer & Limitation of Liability

The Service is provided "as is." To the maximum extent permitted by law, SpexCRM and Spectral Inc. are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability where it cannot lawfully be limited.

Governing Law

These Terms are governed by the laws of South Africa.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify Organization owners by email or via a notice on the platform before the changes take effect.
